Welcome to Say it with socks. Throughout this site, the terms “we”, “us” and “our” refer to Say it with socks. We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink.

Please read these Terms of Service carefully. By accessing or using any part of the site, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any Services.

Section 1 - Access and Eligibility

By agreeing to these Terms of Service, you represent that you are at least 18 years of age, or that you are the age of majority in your state or territory of residence and you have given us your consent to allow any of your minor dependents to use this site.

You must not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

Section 2 - Australian Consumer Law (ACL)

Nothing in these Terms of Service is intended to exclude, restrict, or modify any non-excludable right or remedy you have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  • To cancel your service contract with us; and
  • To a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time.

Section 3 - Products and Accuracy

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.

  • Changes: We reserve the right to limit the sales of our products or Services to any person, geographic region, or jurisdiction.
  • Descriptions: All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion.

Section 4 - Orders and Billing

When you place an order, it constitutes an offer to purchase. We reserve the right to refuse any order you place with us.

  • GST: All prices are in Australian Dollars (AUD) and are inclusive of GST (Goods and Services Tax) unless otherwise stated.
  • Accuracy: You agree to provide current, complete, and accurate purchase and account information for all purchases.
  • Cancellation: In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made.

Section 5 - Shipping and Delivery

Delivery times are estimates only. While we do our best to meet these timeframes, we are not liable for any delays caused by third-party couriers or events outside of our reasonable control.

  • Risk: Risk of loss and title for the items pass to you upon our delivery to the carrier.

Section 6 - Intellectual Property

The Service and its original content, features, and functionality (including "Say it with socks" branding) are and will remain the exclusive property of Say it with socks and its licensors. You may not use our trademarks or intellectual property without our express written consent.

Section 7 - Third-Party Links and Tools

We may provide you with access to third-party tools (like Shopify) or links to third-party websites. We are not responsible for the content, privacy policies, or practices of any third-party services. Any use of optional tools is at your own risk.

Section 8 - Personal Information

Your submission of personal information through the store is governed by our Privacy Policy, which is designed to comply with the Privacy Act 1988 (Cth). Because we use Shopify, your data may be processed and stored outside of Australia.

Section 9 - Prohibited Uses

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content:

  1. For any unlawful purpose.
  2. To solicit others to perform or participate in any unlawful acts.
  3. To infringe upon or violate our intellectual property rights or the intellectual property rights of others.
  4. To upload or transmit viruses or any other type of malicious code.

Section 10 - Limitation of Liability

To the maximum extent permitted by law (and subject to your rights under the ACL), Say it with socks will not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or special damages of any kind arising from your use of any of the service or any products procured using the service.

Section 11 - Indemnification

You agree to indemnify and hold Say it with socks (and our parent, subsidiaries, affiliates, partners, and employees) harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms of Service.

Section 12 - Severability and Termination

If any provision of these Terms is determined to be unlawful or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed from these Terms.

We may terminate this agreement at any time without notice if, in our sole judgment, you fail to comply with any term or provision of these Terms.

Section 13 - Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Queensland, Australia. You agree to submit to the exclusive jurisdiction of the courts of Queensland.
